Arizona Department
of Transportation (Motor Vehicle Division) just announced
clairification of Towing Companies (Selling
Vehicles)
1. Tow Companies may sell
vehicles
a. They have towed
b. They have aquired in the course of that
tow.
c. They have obtained and are in possession of all
the proper paperwork.
2. They may not
sell
a. Vehicles given to them by the public, that was not towed by
them
b. Vehicles purchased from a private
individual
c. Vehicles purchased through an auction.
3. If you are in the business of
towing, you may only sell those vehicles that you towed and are
therefore attached to your business through that tow. You do
need a Dealer Bond and License to sell any other. Follow the
Law and dont get into trouble.

DRIVER JOEY RUBIO KILLED IN PHOENIX HIT AND RUN. MR.
BAKER DIRECTOR OF ARIZONA STATE TOWING ASSOCIATION SAID THAT
THIS ACCIDENT SHOWS THE NEED AND THE REASON TO EDUCATE THE
TOWING INDUSTRY IN SAFETY.
"This is a dangerious
business, you have drivers standing within inches of traffic moving
at 75 - 80 miles a hour, on some of the most dangerious freeways in
the country, and without proper training, they are just asking for
disaster."
States have seen this need and are
gearing their regulations toward mandatory and verifiable formal
training for tow truck drivers. The Federal Government
mandates through DOT that drivers attend formal safety classes every
month as part of their continuing education to drive interstate with
big rigs. Arizona under their new rules mandate all drivers be
certified if they are doing recovery work on contracts with the
State, County or Cities.
California mandates approved
formal training through one of their approved schools. You
don't attend and be certified, you had better not drive a tow truck
in California.
Our towing industry in Arizona
needs to embrace and support the efforts that both State
Associations are doing by sending both new and long time employees
to the training classes. We need to step up to the plate help
others and ourselves by leading the industry toward professionalism
and safety."

DPS AND PHOENIX AUTO THEFT TASK FORCE IS CONDUCTING
RANDOM CHECKS OF ALL TOW YARDS, SALVAGE YARDS, AUCTIONS IN MARICOPA
COUNTY.
THREE SEPERATE YARDS WERE SEARCHED AT RANDOM LAST WEEK ON
BROADWAY ROAD. WE WERE INFORMED BY ONE OF THE YARDS THAT THEY
WERE ESPECIALLY SEARCHING ALL ABANDONED OR READY TO BE CRUSHED
VEHICLES, FOR PROPER PAPERWORK INCLUDING THE CRUSHING PERMITS.
ONE THAT COULD NOT PROVIDE THEM WERE GIVEN A CEASE AND
DISCEST ORDER AND ORDERED TO GO TO COURT AND PROVIDE THE COURT WITH
THE PROPER PAPERWORK.
The tow yard accepted a fine and the case
was dismissed.
NEW RULES AND REGULATIONS WERE PASSED
THIS YEAR BY THE STATE WHICH ALL TOWERS, SALVAGE YARDS AND AUCTIONS
NEED TO BE AWARE OF IN THEIR OPERATIONS. THE STATE SAYS THAT
IT IS YOUR OBLIGATION TO GET THOSE RULES, READ THEM AND
COMPLY.

RESULTING SANCTIONS OR ADMINISTRATIVE DECISIONS IT MAY BRING TO THE
